(Why did you point this out?) Couldn't the flickr user be exempted from the rule? S/he's a pro-democracy activist, you know. That's just like saying "oh this video captured by a North Korean insider can't be used because we don't know his real name." (Chunbum Park 16:07, 19 October 2010 (UTC))
I am no lawyer by any stretch of the imagination. But back in 2008, Stephen Ewen was one of our Constables ( I seem to recall) and also our resident image guru. He set up most of our image uploading "rules". I also recall that his rationale for requiring real names was that anyone with a pseudonym could claim to be the creator or copyright holder of an image when, in fact, he was not ... in other words he was lying and committing a copyright violation. In that case, if CZ had uploaded the image and were sued for the copyright violation, we would be unable to identify the real name of the person who committed the copyright violation and that would hurt our ability to defend ourselves from the litigation.
Once again, I am not a lawyer and I was not involved in Stephen Ewen's setting of the "rules". If you want to question the validity of the rule, I suggest that it probably would be best to take it up with the new EC and MC when the current election is over. I am not the one to unilaterally make any decision regarding changing the current rule.

That is all correct as it stands. I'm just informing you of the present scenario - it doesn't matter who you say he or she is. Real-name data rules could be reviewed by the new councils, but as it stands it can't be used. John Stephenson 09:01, 20 October 2010 (UTC)
